ANJANA MISHRA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Mejorganj P.S.Case No.267 of 2013 registered under sections 302, 201 and 120B/34 of the Indian Penal Code. Case diary in the present case was called for which has been received.

Learned counsel for the petitioner submits that save and except the fact that the petitioner is said to have been last seen with the deceased, there is no other cogent material to implicate this petitioner.

Learned counsel appearing on behalf of the State referred several paragraphs of the case diary in which it is stated

Patna High Court Cr.Misc. No.31957 of 2015 (4) dt.30-10-2015 2/2 that the deceased was having some dispute with Kishori Patel and Harinarain Mahto but not this petitioner.

Considering the aforementioned facts and circumstance of the case and there being no cogent reason in the case diary to implicate this petitioner in the present case, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No.267 of 2013 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) Md.S./- U T
