ANJANA MISHRA ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and the learned counsel for Opposite Party No.2.
As per the earlier direction of this Court, the petitioner and Opposite Party No.2 are present in person. I have interacted with both of them. Save and except a few petty grievances, there is not much in the dispute involved. The petitioner is willing to keep his wife with all honour and dignity. O.P. No.2 is also willing to go and make a fresh start, ignoring what has happened in the past. The petitioner states that he will take all possible steps to maintain harmonious atmosphere at home so that O.P. No.2 is not prejudiced in any manner.
In view of the stand taken by the parties, let the
Patna High Court Cr.Misc. No.29900 of 2015 (4) dt.30-10-2015 2/2 petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samastipur, in connection with Complaint Case No.1014 of 2014 (T.R. No.6483 of 2014), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that if at all there is any untoward incident involving any overt act by the petitioner, it shall be open to O.P. No.2 to seek appropriate legal remedy, which shall include moving this Court for modification/cancellation of this order.
