JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mufassil P. S. case no. 252/2009 registered under sections 379, 385 and other minor sections of the IPC and 27 of the Arms Act.

Petitioner along with others is named in the FIR on the accusation that he as well as his companions demanded extortion money and also gave threat to the informant and others not to cultivate land of Diara.

Submission on behalf of the petitioner is that the aforesaid case was lodged in the year 2009 and up till now,

Patna High Court Cr.Misc. No.14265 of 2018 (2) dt.06-04-2018 investigation against the petitioner is pending. It is further submitted that against one co-accused, namely, Dharnidhar Yadav, police submitted charge sheet and he was put on trial and after full-fledged trial, he was acquitted of the charges. Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Munger in Mufassil P. S. case no. 252/2009 subject to condition as laid down under section 438(2) of the Cr.P.C.
