The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 30(a)/36 of the Bihar Prohibition and Excise Act.

1⁄2 litre of country made liquor has been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is submitted that the house from which the said illicit liquor has been recovered is not a residential house of the petitioner.

Patna High Court CR. MISC. No.54499 of 2022(2) dt.23-11-2022 2/2 Taking into consideration the fact that the said illicit liquor has been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with Mahindwara P.S. Case No.157 of 2021, pending in the court of learned Special Judge, Exclusive Special Excise Court No.I, Sitamarhi.
