JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-12-2015 It has been submitted that the petitioner no. 1, Binod Sah has already been arrested.

Accordingly, the prayer for anticipatory bail of the petitioner no. 1 is dismissed as has become infructuous. Heard both sides.

The petitioners no. 2 to 5, namely, Kishori Devi, Anil Sah, Putali Devi and Bikash Kumar, apprehend their arrest in a case under Sections 304B, 201/34 of the Indian Penal Code. The informant alleged that his daughter was married to Govind Sah, son of Manoj Sah, but after about a year, his daughter was killed and her dead body was hurriedly cremated. It

Patna High Court Cr.Misc. No.50899 of 2015 (2) dt.08-12-2015 2/2 is submitted that the informant made omnibus and general allegation against all other accused persons, but the petitioners are mother-in-law, married sister-in-law and brothers-in-law of the deceased. They have no manner of concern with the family affairs of the deceased and her husband.

Considering the facts aforesaid and the fact that the petitioners are mother-in-law, married sister-in-law and brothersin-law of the deceased and the husband is in jail, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in Ghorasahan P.S. Case No. 230 of 2015 / G.R. Case No. 1053 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
