The petitioner apprehends his arrest in connection with Katihar Nagar P.S. Case No.16 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is that on receiving secret information about carrying the Indian Made Foreign Liquor by a person on a motorcycle to supply the same to someone, the informant along with other police personnel reached at Durga Asthan Chowk, then the person, on seeing the police party, started to flee away, leaving the motorcycle but he was apprehended and on search, one bottle, containing 750 ml. Indian Made Foreign Liquor, was recovered from his possession. On query, he disclosed his name

Patna High Court CR. MISC. No.50493 of 2019(2) dt.14-08-2019 2/2 as Sanjeev Gami alias Gami Mukhiya and also disclosed the name of Chintu Sah and this petitioner, engaged in doing the business of liquor with him.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has been disclosed by the apprehended accused Sanjeev Gami alias Gami Mukhiya. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Katihar, District-Katihar, in connection with Katihar Nagar P.S. Case No.16 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
