The petitioner is apprehending his arrest in connection with Complaint Case No.159 of 2017 registered for offences punishable under Sections 498(A) of the Indian Penal Code. Allegation against the petitioner is of demand of dowry and also torturing her for the same and further he has married with another lady.

Submission of the learned counsel for the petitioner is that he is ready to keep her with dignity and care. Heard learned A.P.P. also.

From perusal of the impugned order it appears that the

Patna High Court CR. MISC. No.55296 of 2019(3) dt.13-09-2019 2/2 matter was referred to the Mediation Centre by the Addl. Sessions Judge but the mediation has failed as the Opposite Party No.2 (wife) is not ready to live with the petitioner as he has married with another lady.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with observation that if he is ready to persuade the O.P.no.2 to live along with him and he will appear along with O.P.no.2 before the learned court below, who will consider this aspect of the matter while considering the prayer for regular bail . With the aforesaid direction, this application is disposed of.
