The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,447,307,379 and 120B of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case is that on 14.8.2015 at 3 P.M. the petitioner along with co accused persons raided the out house of the informant, resorted to firing, caused injury to the servants and took away bicycle and other house hold articles. It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. The accusation is omnibus and general and there is

Patna High Court Cr.Misc. No.51463 of 2015 (2) dt.10-11-2015 2/2 nothing on record to suggest that the injury was caused to any one. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Khagaria (Mufassil) P.S. Case No. 538 of 2015 pending in the court of learned CJM, Khagaria. This application is disposed of with the aforesaid observation/direction.
