JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-05-2016 By way of the present application preferred under Section 482 of the Code of Criminal Procedure, the petitioner seeks quashing of the order dated 23.05.2013 passed by the learned Chief Judicial Magistrate, Bhagalpur in Mojahidpur P. S. Case No. 139 of 2012, whereby cognizance has been taken against the petitioner under Sections 328 and 302 of the Indian Penal Code.
After some arguments, learned counsel for the petitioner seeks leave to withdraw this application in order to raise all the points available to the petitioner before the trial
