The petitioners apprehend their arrest in a case under Section 323, 341, 379, 354, 504/34 of the Indian Penal Code. The informant named four persons and alleged that they all came and Kapildeo Baitha caught her hair, assaulted her and also torn her clothes.

It is submitted that on account of land dispute the case has been lodged and no occurrence, as alleged by the informant, has taken place. Kapildeo Baitha, who is alleged to have assaulted the informant, has already been enlarged on anticipatory bail vide order dated 06.08.2015 passed in Cr. Misc. No. 31940 of 2015 and there is no allegation of assault against the

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in Turkaulia P.S.
