The petitioners, five in number, apprehend their arrest in a case under sections 302, 201/34 of Indian Penal Code. The informant alleged that his daughter was married to Shambhu Nath Mehta, son of petitioners no. 1 and 2. His daughter gave birth to two children. The informant alleged that the accused persons were demanding dowry and on 23.05.2015 the accused persons killed his daughter and cremated her dead body. It is submitted that the petitioners are father-in-law, mother-in-law, brother-in-law and sisters-in-law (Gotni) of the deceased. The marriage was solemnized in the year 2006. The deceased died due to some disease and her dead body was cremated. During the
Patna High Court Cr.Misc. No.50910 of 2015 (3) dt.08-12-2015 2/2 subsistence of marriage for nine years, no complaint was lodged for dowry and torture. The husband of the deceased is in jail. Considering the facts aforesaid and the fact that the petitioners are in-laws of the deceased and the husband is in jail, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in Upahara P.S. Case No. 43/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
