The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 307/34 of the Indian Penal Code.
The prosecution case is of brutally assaulting the informant.
It is submitted by learned counsel for the petitioners that for the occurrence of 16.07.2015 at 7.00 pm, the FIR was registered on 17.07.2015 at 01.40 pm, and at earlier point of time, the wife of petitioner no.1, lodged Complaint Case No.1694 of 2015 on 21.05.2015 against the present informant, levelling accusation under sections 376/511 of the Indian Penal Code, for making an attempt to ravish her. It is further submitted that
Patna High Court Cr.Misc. No.51483 of 2015 (2) dt.10-11-2015 2/2 petitioner no.1 also lodged Dagrua P.S. Case No.160 of 2015 against the present informant, levelling accusation under sections 376/511 IPC on 17.07.2015, for making attempt to ravish her wife. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the cases lodged by the petitioners' side, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with Dagarwa P.S. Case No.161 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
