The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 420, 406 and 409 of the Indian Penal Code.
The petitioner is in-charge of the school during the period 2012-2013 and 2015-2016 and when an information was asked about the status of the fund during that period after auditing it was found that there was defalcation of Rs.21,700/-. Learned counsel for the petitioner submits that as and when it transpires, petitioner has deposited the said amount which is Annexure-2 series.
Looking to the facts and circumstances of the case, in
Patna High Court Cr.Misc. No.19110 of 2018 (2) dt.06-04-2018 the event of arrest or surrender within four weeks from today, let petitioners, namely, Arjun Prasad Rajak, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No.11 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
