====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-03-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Benipatti PS case no. 04 of 2017 (G.R. No. 35/2017) registered for the offences punishable under Sections 403, 420 and 379 of the Indian Penal Code.

The allegation according to the informant is that his ATM Card is said to have been misplaced and thereafter a sum of Rs. 20,000/- and Rs. 20,000/- totaling a sum of Rs. 40,000/- was transferred from his account to the account of the petitioner herein as well as further some money was withdrawn from his account. The learned counsel for the petitioner submits that as

No.5023 of 2018 (3) dt.27-03-2018 2/2 far as the petitioner herein is concerned, only a sum of Rs. 40,000/- has been credited in her account and the petitioner does not have any resources of the same, however, she is ready to deposit the said amount before the Nazarat of the court concerned for the purposes of grant of anticipatory bail. Having regard to the facts and circumstances of the case, the petitioner is directed to deposit Rs. 40,000/- before the Nazarat of the concerned court within a period of four weeks from today whereafter the petitioner shall surrender within the same time before the concerned court and show the receipt of deposit of the aforesaid amount of Rs. 40,000/- before the Nazarat of the said court whereupon she shall be released on anticipatory bail on furnishing bail bonds of Rs.

10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipatti, District Madhubani in connection with Benipatti PS case no. 04 of 2017 (G.R. No. 35 of 2017), subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
