Heard learned counsel for the petitioners, Ms.Shweta Sharma and learned A.P.P. for the State. 2.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 115(2), 117(2), 109 of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioners submits that petitioner No. 1 has antecedent of two cases, petitioner No. 2 is a person with clean antecedent and petitioner No. 3 has antecedent of one case and the informant alleges that while he was constructing his house, when 12 named accused persons including the petitioners came and assaulted him and his family

Patna High Court CR. MISC. No.54539 of 2025(2) dt.25-08-2025 2/3 members by bhala, gadasa causing injury on head of Naresh, Rajdev and Satish, who were taken to NMCH for treatment. 4.

The learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place. It is next submitted that informant was constructing his house over the land of the petitioners. It is also submitted that no specific allegation of assault is alleged against the petitioners. It is next submitted no doubt injury of Vakil and Rajdev has been opined to be grievous but then there is no specific allegation of assault against any of the accused. It is also submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like

Patna High Court CR. MISC. No.54539 of 2025(2) dt.25-08-2025 3/3 amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gurua P.S. Case No. 104 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.

However, it is made clear that in the event, if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioners, despite giving assurance to this Court, are not cooperating in the investigation, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners. 8.
