The petitioner seeks bail in Gopalpur P.S. Case No. 317 of 2020 corresponding to Sessions Trial No. 265 of 2021, registered for the offence punishable under Sections 307, 504, 506, 34 of the Indian Penal Code and section 27 of the Arms Act. Later on, section 302 IPC was added.

As per the FIR, on the order of this petitioner coaccused Akhilesh Modi fired upon the informant, as a result of which he sustained gunshot injury and during course of treatment died.

It is submitted on behalf of the petitioner that as per the FIR petitioner is not the assailant of deceased and she is only order giver. It is further submitted that deceased is Nandosi of the deceased and because of old enmity she has been made

Patna High Court CR. MISC. No.64345 of 2021(2) dt.22-02-2022 2/2 accused in this case. Petitioner claims clean antecedent and she is in custody since 01.09.2020.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IInd, Naugachia, Bhagalpur in connection with Gopalpur P.S.
