2. The petitioner apprehends his arrest in connection with Nawada (Town) P.S. Case No.861 of 2019 registered for the offences punishable under Section 365 of the Indian Penal Code.

3. The First Information Report discloses that the same was lodged against unknown and it was stated that the informant received a phone call from the mobile of his son and it was stated by his son that somebody had forcibly taken him away from Sadbhawana Chowk and a demand of Rs.8 lacs was being made.

4. Learned counsel for the petitioner submits that the

No.56863 of 2024(5) dt.21-04-2025 2/3 petitioner is not named in the FIR and during the course of investigation his brother Vishwajeet Kumar was arrested and it is stated that on the basis of his confessional statement the name of the petitioner has transpired with a story that both the brothers had taken the victim Raviraj along with them on a motorcycle and had confined him in their house.

5. Learned counsel for the petitioner points out that when the victim and the accused persons were known to each other, there is no reason as to why the names were not disclosed in the FIR. It has also been submitted that the case had been filed by brother of the present petitioner against the victim Raviraj as he was not returning his money that was due.

6. Paragraph 17 of the petition also discloses that the petitioner is a government servant serving in Paramilitary and is ready to cooperate in the investigation.

7. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

Taking into consideration the abovementioned facts and circumstances of the case and further that the name of the petitioner has transpired in the confessional statement of the coaccused and he has no criminal antecedent, I am inclined to extend the privilege of anticipatory bail to the petitioner. Let the

No.56863 of 2024(5) dt.21-04-2025 3/3 above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada (Town) P.S. Case No.861 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
