This application is for grant of anticipatory bail for the offence under Sections 406 and 420/34 of the Indian Penal Code. The allegation against the petitioner is that he was Senior Manager of the Company and allegedly defalcated crores of rupees in his possession.
It is submitted on behalf of the petitioner that the petitioner has already resigned from the Company in the year, 2012 and he has nothing to do with the Company. It has also been submitted that one of the co-accused, who is Director of the Company, has already been granted anticipatory bail by this Hon'ble Court, vide order dated
Patna High Court Cr.Misc. No.45495 of 2016 (2) dt.16-12-2016 2/3 11.02.2016 passed in Criminal Misc. No.34863 of 2015. Heard learned A.P.P. also, who has pointed out that the case is of the year, 2013.
Having heard both sides and after consideration of the record and also considering the fact that one of the co-accused of this case having almost similar case has already been granted anticipatory bail by this Hon'ble Court and as per the petitioner, he had already resigned from the Company from before, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four months, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Begusarai in connection with Teghra P.S.Case No.237 of 2013, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
The petitioner is directed to co-operate in the investigation of the case and he present himself before the police on each and every date, if required, and he will co-operate in disposal of the trial.
