====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 27-08-2025 Heard Ms. Sudha, learned counsel appearing on behalf of the petitioners and Mr. Tarun Prasad Mandal, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Vaishali P.S. Case No. 122 of 2025 registered for the offence punishable under Sections 103 and 3(5) of the BNS.

3. The allegation is of committing murder of the sister of the informant.

4. Considering the nature of allegation made in the F.I.R., as well as, the specific allegation against the petitioner no.2, I am not inclined to enlarge the petitioner no.2 on prearrest bail.

5. So far as petitioner no.1 is concerned, considering the nature of allegation alleged against co-accused Ranjit Paswan who is the husband of the deceased and the deceased has left two children to be looked after, the petitioner no.1 Rajendra Paswan is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 122 of 2025, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.

6. The District Court is directed to verify the criminal antecedent of the petitioner no.1 and if it is found that the petitioner no.1 is involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.

7. The bail application stands disposed of.
