1. At the outset, learned counsel seeks permission to make correction in the bail petition.

2. Permission is granted.

3. Heard learned counsel for the petitioner and the State.

4. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323, 337, 338, 379, 3564, 504, 34 of the Indian Penal Code.

5. As per the prosecution case, on the alleged date

No.54544 of 2023(2) dt.21-08-2023 2/3 and time of the occurrence, all the F.I.R. named accused persons including this petitioner entered into the house of the informant and tried to outrage her modesty. It is further alleged that accused persons also snatched golden chain and took away cash of Rs. 70,000/-.

6. It is submitted that as a matter fact, the informant side had assaulted the petitioner and others, for which counter case was lodged by mother of the petitioner Malo Devi vide Civil Lines P . S. Case No. 210 of 2023 and to save skin from this case , petitioner has falsely been implicated in this false and concocted case. Rest of the allegation is super-addition to make the case grave . Petitioner claims clean antecedent.

7. Learned counsel for the State opposes the bail petition of the petitioner.

8. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Excise Judge 1st Gaya in connection with Civil Line P.S. case no. 211 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal
