The petitioner seeks bail in Khaira P.S. Case No. 277/2016, instituted for the offence under Section(s) 461 and 379 of the Indian Penal Code.
It is alleged that theft of laptop, mobile phones, memory cards and other articles has been committed by unknown thieves in the shop of the informant. The petitioner is not named in the FIR. The case diary has been received.
Learned A.P.P. submitted that in para 58 of the case diary there is mention of recovery of mobile phones from possession of the petitioner as IMEI number of the mobile phones, which has been recovered, matches from the IMEI number of the
Patna High Court Cr.Misc. No.7857 of 2017 (3) dt.21-03-2017 2/2 mobile phones, which has been mentioned in the seizure list. It has been submitted on behalf of the petitioner that those mobile phones are not theft articles. The petitioner has no criminal antecedent In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 277/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
