2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148 341, 323, 327, 348, 120B of the Indian Penal Code and section 27 of the Arms Act.
3. Allegation against the petitioner is that he along with other co-accused person assaulted the informant and demanded Rangdari. It is also alleged that petitioner fired upon the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner is neither caught on the spot nor any fire
Patna High Court CR. MISC. No.56306 of 2023(2) dt.15-09-2023 2/2 arm was recovered from his conscious possession. Similarly situated co-accused persons have already been granted anticipatory bail vide order dated 11.04.2023 in Cr. Misc No. 64095 of 2023 and vide order dated 07.04.2023 in Cr. Misc. 4944 of 2023 by the co-ordinate Bench of this Court.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts that the nature of the injury is not mentioned in the impugned order, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Turkauliya (Raghunathpur) P.S. Case No. 174 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.K/- U T
