JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 30-01-2015 Learned counsel appearing on behalf of the petitioner has very fairly submitted that during the pendency of the present writ petition, final order has been passed in the impugned departmental proceeding and the petitioner has been visited with the punishment of dismissal from service.

In view of the aforesaid submission, the present writ petition has become infructuous and it is, accordingly, dismissed. However, the petitioner shall be at liberty to challenge the validity and correctness of the aforesaid final order passed by the disciplinary authority before an appropriate forum/court, which shall be considered in accordance with law without being prejudiced by the present order.
