JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2017 Heard learned counsel for the petitioner and the State.

The petitioner apprehends his arrest in Madhubani Town P.S. Case No. 232 of 2016 instituted for the offence under Sections 341, 384, 379, 506/34 of the Indian Penal Code. It is alleged in the written report that on account of land dispute, the petitioner with other accused as named in the written report gave threat to the informant and made demand of Rs.10,00,000/-, otherwise they said that they will forcibly get possession of his land from his Fua. It is further alleged that they committed loot-pat in the shop of the informant, after breaking the lock. As such, there is general allegation against these petitioners.

Two co-accused have already been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No.35562 of 2016 dated 08.09.2016. In the circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Madhubani Town P.S. Case No. 232 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, subject to the conditions as laid down under Section 438(2) Cr.P.C.
