ANJANA MISHRA ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 13.06.2019, in connection with Saraiya P.S. Case No. 382 of 2019 for the offenses under Sections 272, 273, 414, 420 and 120(B) of the Indian Penal Code and Section 30(a), 32(ii) and 41(i) of the Bihar Prohibition & Excise Act, 2016.
Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner but from a truck which was driven by the petitioner. He has no role in the trade of such liquor and he has no knowledge of the contraband articles loaded by the owner. It is further submitted that the petitioner has got clean antecedent.

No.50241 of 2019(3) dt.05-11-2019 2/2 Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur, in connection with Saraiya P.S. Case No. 382 of 2019.
