1. Heard learned counsel for the petitioner and learned APP for the State, Mr. Rabindra Kumar.

2. The learned counsel for the petitioner submits that the deponent who has sworn the affidavit is own brother of the petitioner, but is also an accused and the office has pointed out the said defect. It is further submitted that no one in the family presently is willing to swear affidavit on behalf of the petitioner.

3. The learned counsel for the petitioner, thus, seeks permission to withdraw the anticipatory bail application with

Patna High Court CR. MISC. No.55556 of 2025(2) dt.02-09-2025 2/2 liberty to file afresh in the event if any family members become ready to swear the affidavit.

4. Permission is accorded.
