24-02-2022 Heard Sri Sarva Deo Singh, learned counsel for the petitioner and Sri Arvind Kumar, learned counsel for the Vigilance Department.

The petitioner seeks bail in Vigilance Special Case No. 21 of 2021, arising out of Vigilance (Patna) P.S. Case No. 32 of 2021, registered for the offence under Section 7(a) of Prevention of Corruption Act.

It is a trap case, in which, this petitioner was caught red-handed while accepting bribe of Rs. 10,000/- (Ten Thousand).

It is submitted on behalf of petitioner that in this case, investigation is complete and petitioner is in custody since 23.08.2021.

No.64980 of 2021(2) dt.24-02-2022 2/2 However, learned counsel for the Vigilance Department has vehemently opposed the bail petition and submitted that this petitioner was caught red-handed while accepting bribe of Rs. 10,000/- from the complainant/informant for clearance of his pending bills amounting to Rs. 3,00,000/-. Considering the rival submissions of the parties and materials available on record, the prayer for bail of petitioner is rejected.

However, once charge is framed and trial commences, the petitioner shall be released on bail by the learned trial court on the condition that he will cooperate in disposal of trial and appear before the trial court, as and when required. With above observation, the petition stands disposed of.
