2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 420, 406, 376, 376(b), 493, 313, 506 of the Indian Penal Code.
3. Prosecution case relates to establishing physical relation by the petitioner with the informant on the pretext of marriage resulting into pregnancy. It is further alleged that petitioner took Rs. 10 lakh from the petitioner on assurance of return but he stopped contacting the informant.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case.
Patna High Court CR. MISC. No.54654 of 2023(2) dt.29-08-2023 2/2 Petitioner is innocent. After prevailing good sense, matter has been compromised and annexure-2 series is compromise petition annexed with this petition. Petitioner is languishing in judicial custody since 10.03.2023.
5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Mahua P.S. Case No. 600 of 2022.
