====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections-3, 4 & 5 of Bihar Mines Act. It has been submitted that the petitioner is driver of the truck bearing registration No. UP-67T-1142, from which, allegedly, stone chips were found. On demand, he could not be able to produce the paper. It has been submitted that the petitioner has been arrested due to confusion because as a matter of fact, he was holding valid paper which was later on, produced before the authority. The petitioner is said to be in custody since 20-10-2016. It is mentioned at paragraph-3 of the petition that the petitioner has got no criminal antecedent.
Considering the above-said facts and circumstances of
Patna High Court Cr.Misc. No.4379 of 2017 (2) dt.13-02-2017 2/2 the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Baroon P.S. Case No. 157 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Aurangabad subject to condition that both the bailors will be close relatives of the petitioner.
