The petitioner apprehends his arrest in connection with Akbarpur P.S. Case No. 280/2017 registered for the offences punishable under Sections 147/341/323/448/307/354/379/504/506 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is case and counter case between the parties and the altercation had taken place on account of erection of wall near the house of the petitioner. It is further submitted that though it is alleged that the petitioner had attacked with Gandasa, the injury is said to have been caused by hard and blunt substance and simple in nature. Having considered the entire nature of allegation made and also there is case and counter case between the parties,
Patna High Court Cr.Misc. No.16521 of 2018 (2) dt.09-04-2018 2/2 let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Nawadah, in connection with Akbarpur P.S. Case No. 280/17, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
