JUSTICE BIRENDRA KUMAR ORAL ORDER 09-01-2017 The Court below while disposing of the prayer for anticipatory bail observed in last paragraph as follows : "From perusal of the record, it appears that the earlier ABP No. 7470 of 2016 of this accused petitioner was rejected by this court vide order dated 28.04.2016, however, considering the facts of affidavit dated 25.11.

2016 filed on behalf of the accused petitioner, the accused petitioner is directed to surrender before the learned court below within a month from the date of communication of this order and the learned court below shall consider matter sympathetically on the basis of compromise between the parties without being prejudiced by this order. Accordingly, the present anticipatory bail petition stands disposed of." In view of the aforesaid observation, this anticipatory bail application is disposed of with direction to the petitioner to comply the aforesaid order.
