Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Darbhanga Town P.S. Case No. 97 of 2018 lodged under Sections 341, 323, 504, 506, 307 and 498(A)/34 of the I.P.C. in which sections 302, 304(B) and 120(B) of the I.P.C. have been added later on.
As per prosecution case, the deceased was murdered by pouring kerosene oil on her body. The entire family members
Patna High Court CR. MISC. No.58195 of 2022(2) dt.09-11-2022 2/3 were accused in this case.
Learned counsel for the petitioner submits that the trial of the husband of the deceased has concluded in which he has been acquitted (Annexure-4 of the petition). Learned counsel further submits that the sasur and devar of the deceased were granted regular bail by the Co-ordinate Bench of this Court vide order dated 03.03.2022 passed in Cr. Misc. No. 57683 of 2021. Learned counsel further submits that petitioner is old aged mother-in-law (about 75 years) who is in custody since 14.05.2022. Counsel for the petitioner has filed a supplementary affidavit today by which he informed to this Court that husband of the petitioner died and his Shradh Karm is fixed on 07.11.2022 to 11.11.2022, on this ground this mentioning slip was accepted. Counsel for the petitioner further submits that the trial of the husband of the deceased has already been concluded in which he has been acquitted and another accused persons have been granted bail.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees
Patna High Court CR. MISC. No.58195 of 2022(2) dt.09-11-2022 3/3 Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 97 of 2018, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
