Petitioner seeks regular bail in Agamkuan P.S. Case No.209/13 under Sections 302, 120(B)/34 of the I.P.C and 27 of the Arms Act.

Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier refused vide order dated 29.06.2016 passed in Cr.Misc. No23608/16 with direction to the trial court to conclude the trial of the petitioner within six months by taking all steps. If the trial of the petitioner is not concluded within the aforesaid period, the petitioner would be at

Patna High Court Cr.Misc. No.10734 of 2017 (2) dt.08-03-2017 2/2 liberty to renew his prayer for bail. But the trial has not yet been concluded. Further submission is that one accused whose trial was separated on the ground of his juvenility his record is returned declaring him major and the prosecution witnesses who have been examined are reexamined on recall.

In view of the aforesaid facts and circumstances of the case, let the petitioner, abovenamed , be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge,III, Patna inS.Tr.No.311/14 arising out of Agamkuan P.S. Case No.209/13.
