JUSTICE SUDHIR SINGH ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 420, 467, 468, 471, 379 and 120B of the Indian Penal Code.
Allegation against the petitioner is that he sold two pieces of land and had assured informant of providing another piece of land in lieu of that land. Petitioner used to provide yield to the informant but now he has stopped.
It is submitted on behalf of the petitioner that he has been made accused due to mistake of fact. From perusal of the prosecution case it is evident that the matter relates to civil nature. Petitioner claims to be the bonafide title holder of the land in question which has been executed by him. Father of the informant is the witness to the sale deed.
On behalf of the State and the informant, it is submitted that petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in
Patna High Court Cr.Misc. No.52728 of 2015 (3) dt.19-02-2016 2/2 the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiyarpur P.S. Case no. 283 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
