JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Bhabhua P.S. Case No. 721 of 2017 for the offences punishable under sections 341, 323, 354 (B), 379, 506 and 504/34 of the I.P.C.

Allegedly, the petitioners intentionally got grazed the crops of the informant by their cattle and when the informant forbade them they started abusing and assaulting the informant, his wife and his son and further Vakil Ram snatched Mangal Sutra. Vakil Ram after catching hands of daughter and wife of the

Submission is of false implication and that there is case and counter case, the petitioners have been falsely implicated in this case, no offence under section 354 (B) I.P.C. is made out, the allegation under section 379 I.P.C is super addition, all the injuries received by the injured are simple in nature and as such the petitioners deserve sympathetic consideration as they have got no criminal antecedents.

The learned A.P.P. fairly submits that there is case and counter case.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Kaimur (Bhabua) in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
