JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
Allegation is that the victim was done to death by her in-laws including the petitioner, who is husband. Death was caused for non-fulfillment of demand of dowry. Submission of the petitioner is that the eldest son is aged about 11 years and younger son is aged about 6 years. There is no previous complaint of demand of dowry and after death case has been lodged on suspicion.
Considering the aforesaid facts, let petitioner, above
Patna High Court Cr.Misc. No.9763 of 2017 (3) dt.28-03-2017 named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur/Successor Court, in connection with Patory P.S. Case No. 104 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
