JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 324, 504, 506, 307/34 of the Indian Penal Code.

The prosecution case is that the accused persons were cutting ridge of the land of the informant. On protest being made the cousin brothers of the informant Chano Yadav, Chunu Yadav, Sanju Devi along with petitioner Arun Yadav came armed with 'lathi' and 'khanti' assaulted the informant's sons namely Sudhir Yadav, Shailendra Yadav and informant's wife Janta Devi causing injury on their head.

It is submitted by learned counsel for the petitioner that accusation is omnibus and general and in the background of land dispute the accusation has been levelled. Injury has been found to

Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Barhat P.S. Case No.58/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
