JUSTICE SANJAY PRIYA ORAL ORDER 2/ 23-02-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners apprehend their arrest in Sheosagar P.S. Case No.329 of 2017 instituted for the offence under Section(s) 147, 148, 149, 325, 323, 307, 504, 506 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner has submitted that instant case is counter blast of Sheosagar P.S. Case No.328 of 2017 lodged by the petitioner no.2 against the informant and his family members in which petitioner no.1 sustained sharp cut injury and Sachidanand Singh sustained fire arm injury.

In the instant case, there is allegation that while the

Patna High Court Cr.Misc. No.10177 of 2018 (2) dt.23-02-2018 2/3 informant was constructing boundary wall then Munna Singh and Raju Singh (petitioner nos.3 and 4) assaulted the informant with lathi causing injury in his leg and rib.

In this manner, it appears that injuries have been sustained from both sides. Occurrence took place on account of land dispute. There is case and counter case. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Sheosagar P.S. Case No.329 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Judge VII-cum-ACJM, Rohtas, Sasaram, subject to the conditions as laid down under Section 438(2) Cr. P. C.

Patna High Court Cr.Misc. No.10177 of 2018 (2) dt.23-02-2018 3/3 in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
