JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 The petitioner is in custody since 21.10.2016 in connection with Ganga Bridge P.S. Case No. 58 of 2014, registered for offences punishable under Sections 302, 201 and 34 Indian Penal Code.

Allegation against the petitioner that he along with other accused persons has murdered his wife.

It has been submitted on behalf of the petitioner that there is no eye-witness of the present occurrence and the deceased might have been killed in some other manner and since the petitioner is husband, he has been falsely implicated in this case. Further on the alleged date of occurrence petitioner was not present in the village. Petitioner has been in judicial custody since 21.10.2016.

Patna High Court Cr.Misc. No.17642 of 2017 (2) dt.17-04-2017 2/2 Learned counsel for the State opposed the prayer for bail. Having heard both sides, from perusal of the impugned order itself, it appears that in paragraph 24 to 26 of case diary, witnesses have supported the case of prosecution and have specifically stated about the involvement of petitioner in the present offence and also during investigation materials have come showing involvement of this petitioner in the alleged offence, as such, I am not inclined to grant him the privilege of regular bail, his prayer for bail is accordingly rejected.
