The petitioner has preferred this application for grant of regular bail in a case registered under sections 8, 20 and 22 of the NDPS Act and sections 25(1-B)(a), 26 and 35 of the Arms Act .
As per the prosecution case, one loaded country-made pistol with a live cartridge and 500 gms of charas was recovered from possession of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 28.6.2021 and investigation in the case
Patna High Court CR. MISC. No.64363 of 2021(3) dt.13-05-2022 2/2 has concluded.
The application for bail is opposed by learned APP for the State who submits that huge quantity of charas was recovered from the petitioner's possession who also has five antecedents before this case.
Having heard learned counsel for the parties and taking into consideration the recovery of 500 gms of charas besides arms and ammunitions from possession of the petitioner, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
