2. The petitioner seeks bail in connection with Bhawanipur P.S. Case No. 93 of 2025 dated 17.04.2025 instituted for the offence punishable under Sections 103(1), 3(5) of Bhartiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that on the alleged date of occurrence, an altercation took place between the son of the informant and accused persons as the cattle of co-accused Amar Kumar were tied in the way. It is alleged that Amar Kumar assaulted his son by means of sharp Bamma and scissors. Allegation against the petitioner is that she assaulted indiscriminately the son of the informant by means of bamboo. Thereafter his son succumbed to the injuries.

4. Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in this case. Learned counsel for the petitioner submits that there is specific allegation against co-accused Amar Kumar that he assaulted the deceased by sharp weapon. The petitioner has been made accused in this case only because she is the wife of Amar Kumar. Allegation against the petitioner is that she assaulted the deceased by means of bamboo stick. In the impugned order itself, injury as per the post-mortem report has been discussed which are 'stitched wound present on left side of forehead. Size of wound 3" x 1". Punctured wound present on 7th & 8th intercostals space below midaxillary line. Cause of death is due to shock and hemorrhage due to sharp penetration weapon'. It is further submitted that the petitioner is lady aged about 24 years. Lastly, it has been submitted that the petitioner is in custody since 17.04.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of
