JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-04-2018 Heard Mr. Jai Prakash Verma, learned counsel for the petitioner and learned counsel appearing on behalf of the State. The grievance of the petitioner in the present writ application is non-payment of salary and allowances despite the fact that the petitioner is regularly working as peon in the College in question.
The State Government has released fund for payment of salary and allowances to the teaching and non-teaching employees and accordingly, it is obligation of the State Government to see that the money allocated must reach the
Patna High Court CWJC No.1139 of 2016(3) dt.12-04-2018 2/2 persons who are entitled to such payment under the scheme enumerated by the State Government.
Under the aforesaid circumstances, instead of keeping the matter pending, the writ petition is disposed of with liberty to the petitioner to approach the respondent No. 4, the Director, Secondary Education, Government of Bihar who shall look into the grievance of the petitioner and pass reasoned and speaking order with regard to the claim of the petitioner and take corrective measures in the distribution of the fund allocated by the State Government. Such exercise must be completed within two months from the date of receipt/production of a copy of this order.
