1. Heard learned counsel for the petitioners and Mr. Chandra Bhushan Prasad, learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302, 504 and 506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners no. 1 and 2 have antecedent of one case and petitioner no. 3 is a person with clean antecedent. It is further submitted that Vishwanath Singh @ Vishwanath Sah along with two others had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 57094 of 2024. It is next submitted that
Patna High Court CR. MISC. No.65734 of 2024(3) dt.11-02-2025 2/3 since Vishwanath Singh was arrested during pendency of Cr. Misc. No. 57094 of 2024, as such, his anticipatory bail application was permitted to be withdrawn while Shiv Nath Shah @ Shiv Nath Sah and Ajaj Shah @ Ajay Sah @ Ajay Kumar were granted the privilege of anticipatory bail by an order dated 06.08.2024 and the case of the petitioners is also akin to the case of Shiv Nath Shah @ Shiv Nath Sah and Ajaj Shah @ Ajay Sah @ Ajay Kumar. It is also submitted that petitioners will not abscond rather will cooperate in the investigation to prove their case.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Kateya P.S. Case No. 02 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. However, if the investigating officer of the case files an application before the learned trial court bringing to its notice that the petitioners despite giving assurance to this Court are not cooperating in the investigation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
