The petitioner apprehends his arrest in connection with Kochadhaman P.S. Case No. 230 of 2016 registered under Section 7 of the Essential Commodities Act.
The accusation is that, in course of checking, one auto rickshaw was found loaded with two quintals of rice. After inquiry, it has come that the said rice was carried from the fair price shop of the petitioner. Thereafter, on verification, shortage of six quintals rice was found in the shop of the petitioner. Learned counsel for the petitioner submits that, in fact, bags of the rice, which were found short in the shop of the
Patna High Court Cr.Misc. No.53296 of 2016 (2) dt.16-12-2016 petitioner, was not weighed only the number of bags were counted. It is further submitted that petitioner has no concerned with the rice recovered from the auto rickshaw and the licence of fair price shop (P.D.S) of the petitioner was cancelled due to institution of the present case.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Ist, Kishanganj, in connection with Kochadhaman P.S. Case No. 230 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
