The present application seeks modification in the order dated 17.09.2016 passed in Cr. Misc. No. 35474 of 2016 (Annexure-1) insofar it relates to petitioner no. 9 who is applicant of the present case.

Stating the reasons in the application, it is submitted that due to the illness, he could not surrender within time and furnish the bail bonds.

Considering the facts and circumstances of the case, the present application is allowed. The time granted under order dated 17.09.2016 passed in Cr. Misc. No. 35474 of 2016 for surrender of the petitioner is extended to 4th of January, 2017 subject to the condition that along with the bail bonds, the petitioner shall enclose receipt/document showing a deposit of Rs. 500/- with the

Patna High Court Cr.Misc. No.53636 of 2016 (2) dt.14-12-2016 2/2 District Legal Services Authority of the district. The said order dated 17.09.2016 in Cr. Misc. No. 35474 of 2016 was passed in Mairwa P.S. Case No. 67 of 2016 granting bail to the petitioner to the satisfaction of learned A.C.J.M.-III, Siwan.
