The petitioners seek bail in K. Nagar (Marnga) P.S. Case No. 62/2017, registered for the offence punishable under Section 379 of the Indian Penal Code. Later on, sections 411 and 414 of the Indian Penal Code were added.

The informant lodged the case against unknown for theft of four motorcycles.

Learned counsel for the petitioners submits that one Pankaj Kumar Yadav was arrested and he confessed his guilt. Pankaj Kumar Yadav disclosed the name of the petitioners. No motorcycle was recovered from the possession of the petitioners. Mobiles are said to have been recovered from the possession of

Patna High Court Cr.Misc. No.19123 of 2017 (2) dt.26-04-2017 the petitioners, but the informant did not say that any mobile was stolen. The petitioners are in jail since 22.02.2017 and petitioners have got no criminal antecedent.

Considering the facts aforesaid, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with K. Nagar (Marnga) P.S. Case No. 62/2017.
