The petitioners apprehend their arrest in Dumra P.S. Case No. 360/2014, registered for the offences punishable under Sections 379, 384, 452 and other sections of the Indian Penal Code.
The informant alleged that the petitioners and others came and asked the informant and his family members to withdraw the case earlier lodged by the informant. On refusal the accused persons assaulted the informant and also took away different articles.
Learned counsel for the petitioners submits that the police after investigation submitted final form finding the case
Patna High Court Cr.Misc. No.55288 of 2016 (2) dt.22-12-2016 2/2 false against the petitioners, but the learned court below took cognizance differing with the finding of the Investigating Officer. No injury was found on the persons of the informant or any other persons.
Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Sitamarhi in connection with Dumra P.S. Case No. 360/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
