Petitioner apprehends arrest in connection with Banka Mahila P.S. Case N. 30 of 2015 registered under Sections- 498A, 494, 323, 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is still ready to keep the informant, but it is the informant who does not want to live with this petitioner. Petitioner has not solemnized second marriage. Petitioner never demanded any dowry nor tortured the informant. Petitioner has no criminal antecedent.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner being the husband
Patna High Court Cr.Misc. No.53457 of 2016 (6) dt.17-08-2017 2/2 is responsible to maintain his wife.
Considering the facts and circumstances of the case and the allegations levelled against the petitioner, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is, therefore, rejected. (Arvind Srivastava, J) Manish/- U T
