JUSTICE SUDHIR SINGH ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 304B, 120B and 201/34 of the Indian Penal Code.

Allegation against the petitioner is of killing daughter of the informant due to non-fulfilment of demand of dowry. It is submitted on behalf of the petitioner that he has got no criminal antecedent. Petitioner has been made accused due to mistake of fact. The deceased is said to have died of accidental death. No specific allegation has been made against him. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and husband of the deceased. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.

Any how, if the petitioner surrenders in the court below, i.e., Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P. S. Case no. 197 of 2014 within a period of six weeks from today and pray for regular bail, same shall be
