The petitioner seeks bail in Samastipur Town Muffasil P. S. Case No. 291 of 1998 registered under Sections 25A, 1-A, 1-B and 26(2) of the Arms Act.

Learned counsel for the petitioner submits that the petitioner was granted bail and he appeared in the Court for more than seven years but the trial could not be concluded. He submits that the petitioner went outside the village to earn livelihood. His bail bond was cancelled on 13.12.2006. The petitioner has misused the privilege of bail for about 10 years and for that the petitioner is in jail since 28.09.2016. The petitioner has already remained in jail for about six months for misuse of privilege of

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 5th, Samastipur in Samastipur Town Mufasil P.S.
